Camarades,
dans le cadre de la solidarité internationale du travail, je joins à l’appel à la manifestation du 15 mai la réponse que m’a adressée, le 1er MAI 2018, Mahmoud ZIADA secrétaire général de la Fédération palestinienne des syndicats indépendants (GFIU) , à ma question sur les violations des droits des travailleurs palestiniens.

VIOLATIONS DES DROITS DES TRAVAILLEURS PALESTINIENS EN ISRAEL

Pour pouvoir travailler en Israël, tout travailleur palestinien doit obtenir une autorisation, autorisation soumise à de nombreuses conditions ; âge, état civil, être marié et avoir des enfants, etc.

L’autorisation ne vaut que pour une place de travail et une période définies.
La personne n’a le droit de choisir ni le travail, ni la période.

Pour obtenir l’autorisation, on doit passer par l’intermédiaire de sous-traitants et de commissionnaires qui conditionnent le maintien de l’autorisation au prélèvement d’une part du salaire.

Il y a discrimination entre travailleurs palestiniens et travailleurs israéliens pour les salaires et pour les droits sociaux.

Des ordres militaires peuvent à tout moment interdire des zones entières de territoire. Parfois, la confiscation de l’autorisation de travail par les soldats au checkpoint.
Les places de travail sont restreintes aux secteurs inférieurs du marché du travail, travail au noir, bâtiment, services et nettoyage.

Les prélèvement sociaux et syndicaux sont faits sans l’accord des personnes (elles n’en bénéficient pas). Il y a des instructions pour limiter l’application du droit du travail.

Quelques statistiques et informations

Le niveau du chômage est de 27,7 % selon L’OIT et concerne 364 000 personnes dont 50 % de jeunes qui n’ont ni protection sociale, ni éducation et se trouve dans l’impossibilité de se marier. Ces chiffres ne tiennent pas compte des personnes qui renoncent à demander un emploi.

75 % des travailleurs du secteur privé sont exclus d’une protection légale basique comme le congé maladie ou les vacances annuelles.

36 % des salaires sont inférieurs au salaire minimum légal.

Dans les conflits du travail, l’absence de tribunaux spécifiques rend les procédures extrêmement longues.

Le ministère du travail manque de volonté pour faire appliquer la loi. Les nouvelles ordonnances visent à limiter le droits des travailleurs à s’organiser, à négocier, elles interdisent la grève dans divers secteurs.

La GFIU se bat contre l’alliance entre l’établissement politique (sous occupation israélienne) et les employeurs privés pour améliorer le droit du travail.

Here are some of the violations facing Palestinian workers in the Israeli labour market.

Any Palestinian worker wants to work in Israel should have a permission. These are many conditions includes the age, social status such as to be married with kids.

The permission is defined the workplace the period of work. The worker do not have the right to choose the kind of work or the time.

To get the permission through subcontractors and commissioners who blackmail the workers and take part of there wages to keep their permit.

The discrimination between the Palestinian and Israeli workers such as wages and social protection.

In some cases by the military order preventing citizens of an area or family or other conditions.

In other cases the soldiers confiscate the permissions at the checkpoint.

Palestinian workers concentrate in the down black labour in construction , services and cleaning.

Palestinian workers in Israel still paying memberships fees without workers agreement.

Here some statistics and points about the situation in the labour market

Participation in labour force around 45.3% ( 70% males and women 19%)

27.7% unemployed workers (364 thousands) according to ILO indicators. This figure do not include workers who stopped looking for work. The unemployment rate among the young people reached 50% of the un employed (these are outside the social protection, no education or marriage).

75% of workers in the private sector still without basic rights such as annual leave or holidays, sickness leave or

36% of workers get less than the minimum wage.

Absence of specialized labour courts and the long procedures.

Weakness of well in the labour ministry to follow the implementation of the law.

The right to strike has been limited and there are new orders by the authority to forbidden the strike in different sectors.

Consequently this make it more difficult to negotiate or collective bargaining or social dialogue

As a result the right to organize cant be implemented and without meaning without the right to strike. This make it more hard to

Nowadays, there are discussion on the draft trade unions law to give a legal right for the restrictions on the rights to organize and negotiations.

We as a federation trying to work under these condition and to resist and to fight against the alliance between the political establishment and the private sector.

We also trying to influence the trade unions law.

We are also involved in the campaign against the communications companies to reduce the prices and to improve the quality of the services to customers. The number of the campaign reached 00 thousand people. The campaign continue and we believe that this action put the trade unions in the heart of the social movement and the fight for social justice.
